Commercial and Residential Tax Assessment Appeals

Manage your annual tax obligation

Property owners have the right to challenge the assessment placed on their property on an annual basis. However, it’s not always easy to tell whether an appeal is worthwhile. When it is worth your time, a tax appeal is similar to other kinds of litigation, and the assistance of an experienced attorney can help you to obtain a favorable result.

In addition, many municipalities in New Jersey have become more active in reassessing and revaluing the property in their districts. Sometimes, the effect on your tax assessment can be startling. A proactive approach to property tax management during a revaluation or reassessment can help to reduce or avoid an unpleasant surprise when your town’s final tax bills are issued.

Like any other form of litigation, a tax assessment appeal requires some investment of time and energy. At The Englert Law Firm, LLC, we offer complimentary consultations to determine if that investment will be rewarded. Contact us today to see if a property tax appeal is right for your home or business!

Residential appeals

Large property tax bills can drastically increase the cost of your monthly mortgage payment. Or, if you own your home, a large property tax bill can adds to your annual expenses, often at the very time when every dollar counts. The Englert Law Firm, LLC can help.

Revaluations & Reassessments

Municipalities in New Jersey are performing reassessments and revaluations to update their tax rolls. This can result in a significant increase in your property assessment. The Englert Law Firm, LLC can help you to understand the process and determine if an assessment appeal would benefit you.

Property Tax Exemptions and Abatements

Tax Exemptions

The law provides for a number of exemptions from property taxation, including exemptions for some property owned and used by schools, hospitals and religious institutions. The exemption laws are complex, and The Englert Law Firm, LLC can help you navigate the statute to determine if your property could qualify for an exemption.

Tax Abatements

New Jersey law offers incentives for developers for new and rehabilitated properties that will help communities develop and grow. The Englert Law Firm, LLC can help you identify and take advantage of these advantages where they exist.

Farmland Assessment

The law provides for preferential tax treatment of land that is devoted to agricultural or horticultural uses. However, there are strict requirements to qualify for preferential treatment, and failing to carefully navigate those restrictions can result in a denial of farmland assessment or rollback taxes. The Englert Law Firm, LLC can help qualifying property owners obtain and preserve farmland assessment.

Appellate Advocacy

The Right of Appeal

At the conclusion of most trial proceedings, litigants have the right to file an appeal. This right is not automatic; it must be invoked by the litigant within the time provided by the court rules. In the face of an unfavorable decision by a trial court, knowing whether, when and how to file an appeal is crucial.

The Appellate Difference

At its core, litigation is a two-stage process - trial and review. The trial stage involves gathering evidence and preparing to convince a finder of fact that the circumstances do or do not warrant some form of relief from the court. The review stage is not a second trial, but instead an examination of the trial stage for legal errors, from initial pleadings all the way through post-trial motion practice. The ability to distinguish between an effective trial argument and an effective argument on appeal is crucial for the appellate advocate. Identification of viable issues for appeal, joined with powerful brief writing and careful oral argument capitalizing on those issues, are the cornerstones of our appellate practice.
